57/2017: Receipt of a statement of claim against PBG filed by GDDKiA

The Management Board of PBG S.A. (the “Company” or “PBG”) announces that on November 14th 2017 it was notified that the State Treasury – General Directorate for National Roads and Motorways (“GDDKiA”) filed a claim against PBG, the Bankruptcy Administrator of APRIVIA S.A. w upadłości likwidacyjnej (in liquidation bankruptcy) and the Bankruptcy Administrator of Hydrobudowa POLSKA S.A. w upadłości likwidacyjnej (in liquidation bankruptcy) (the “Defendants”) for payment of liquidated damages with compounded interest for termination of the ‘Construction of Motorway A4 Tarnów-Rzeszów (from the Krzyż junction to the Dębica Pustynia junction, from 502+796.97 km to ca. 537+550 km)’ contract (the “Contract”), executed by a consortium including the Defendants. The total amount of the claim is PLN 264,875,107. As part of that amount, the plaintiff is seeking to be awarded from PBG the principal of the liquidated damages of PLN 176,361,140.69, and to be awarded jointly and severally from all the Defendants of compounded default interest of PLN 88,513,965.38, all amounts together with statutory default interest accrued from the date of filing the claim until the actual payment date.

 

The Company’s Management Board is of the opinion that the claim is groundless. The Company together with the other consortium members is pursuing claims against GDDKiA for payment of PLN 508,041,844.73 in a separate lawsuit, as announced by PBG in Current Report No. 11/2017 dated March 3rd 2017.

The recipients of your personal data shall be the persons authorised by the Controller, i.e. the employees and associates who have to have access to the data to perform their duties, and the Controller's Providers to whom the Controller entrusts the processing of the personal data under and based on the data processing agreements and in line with the requirements of Article 28 of GDPR (i.e.: the provision of IT services).
  6. Giving your personal data is voluntary. However, your refusal to give it prevents us from sending you the newsletter.
  7. You have the right to request from the Controller the access to your personal data. Moreover, you can correct your personal data, delete it or limit its processing, and you have the right to withdraw your consent for data transfer.
  8. You have the right to file a complaint to a supervisory body.
