114/2012: Ruling by the Regional Court of Gliwice.

Being aware that the only RAFAKO employee with access to the ESPI system is Mr Wiesław Mariusz Różacki, President of the RAFAKO Management Board, who has been suspended from duties by the Supervisory Board on November 16th 2012, and given that RAFAKO S.A. is a PBG’s subsidiary, the Management Board of PBG S.A. in company voluntary arrangement reports that it has received a copy of a ruling by the Regional Court of Gliwice, dated November 21st 2012, whereby the Court refused to interpret its ruling of November 15th 2012.

Having examined a motion submitted by Wiesław Różacki, Dariusz Karwacki and Bożena Kawałko, the Regional Court of Gliwice concluded that the ruling of November 15th 2012 does not apply to suspension of management board members from duties. The Company’s Supervisory Board has not been deprived of its statutory or corporate powers to suspend management board members from duties for important reasons.

Therefore, pursuant to the Court's ruling of November 15th 2012, there are no legal grounds for challenging the suspension of Management Board members Wiesław Różacki, Dariusz Karwacki and Bożena Kawałko from duties, as per the Supervisory Board's resolutions of November 16th 2012.

The PBG Management Board was notified of the decision by the Rafako Supervisory Board.

  4. Your personal data shall be stored until you request to cancel the subscription.
  5. The recipients of your personal data shall be the persons authorised by the Controller, i.e. the employees and associates who have to have access to the data to perform their duties, and the Controller's Providers to whom the Controller entrusts the processing of the personal data under and based on the data processing agreements and in line with the requirements of Article 28 of GDPR (i.e.: the provision of IT services).
  6. Giving your personal data is voluntary. However, your refusal to give it prevents us from sending you the newsletter.
  7. You have the right to request from the Controller the access to your personal data. Moreover, you can correct your personal data, delete it or limit its processing, and you have the right to withdraw your consent for data transfer.
  8. You have the right to file a complaint to a supervisory body.
  9. Giving your personal data is voluntary.
