31/2012: Creditor petition for a subsidiary’s bankruptcy
The Management Board of PBG S.A. hereby reports that on May 16th 2012 it was notified that on May 10th 2012 the District Court for Poznań – Stare Miasto in Poznań, 11th Commercial Division for Bankruptcy and Recovery, (“the Court”) had issued an injunction to secure the assets of a debtor – Przedsiębiorstwo Drogowo-Mostowe DROMOST sp. z o.o. (“the Subsidiary”), by appointing a provisional court supervisor. The injunction was issued in response to a request by Andrzej Kasprzak, the Subsidiary’s creditor conducting business activities under the name of Przedsiębiorstwo Sprzętowo Transportowe Andrzej Kasprzak (“the Creditor”), for securing the debtor’s assets by appointing a provisional court supervisor, included in the Creditor’s petition for the Subsidiary’s bankruptcy by liquidation of its assets, filed with the Court on April 4th 2012. The Management Board of PBG S.A. hereby reports that as at the date of the petition the Subsidiary’s debt towards the Creditor was PLN 863,126.34.
A majority interest in the Subsidiary is owned by APRIVIA S.A., holding 99% of the company’s share capital and of the total vote at the company’s general meeting. The sole shareholder of APRIVIA S.A. is PBG S.A.
