54/2012: Termination of credit agreements by financing banks

The Management Board of PBG S.A. hereby reports that on June 11th 2012 it received the following notices:

1)      from Nordea Bank Polska S.A. - a notice of termination of Credit Agreements No. FKR-PLN-ZOKK1-11-000012 and FKR-PLN-ZOKK1-11-000011 concerning an overdraft facility, dated March 22nd 2011, executed with APRIVIA S.A., PBG's subsidiary, in their entirety, within seven days from the date of service of the notice. The notice has been served on grounds of threatened insolvency of APRIVIA S.A.;

2)      from Nordea Bank Polska S.A. - a notice of termination of Credit Agreement No. FKR-PLN-ZOKK1-10-000073 of November 19th 2010 and Credit Agreement No. FKR-PLN-ZOKK1-09-000011 concerning an overdraft facility, dated April 10th 2009, both executed with Hydrobudowa Polska S.A., PBG's subsidiary, in their entirety, within seven days from the date of service of the notice. The notice has been served on grounds of threatened insolvency of Hydrobudowa Polska S.A.;

3)      from BZ WBK S.A. - a notice of termination, within seven days, of Overdraft Facility Agreement No. K0007256 of December 30th 2011 executed with PBG S.A., on grounds of loss of creditworthiness and filing of the insolvency petition;

4)      from BZ WBK S.A. - a notice of termination, within seven days, of Overdraft Facility Agreement No. K0007258 of December 30th 2011 executed with Hydrobudowa Polska S.A., on grounds of its threatened insolvency;

5)      from BZ WBK S.A. - a notice of termination, within seven days, of Overdraft Facility Agreement No. K0007257 of December 30th 2011 executed with Hydrobudowa Polska S.A., on grounds of its threatened insolvency;

6)      from Raiffeisen Bank Polska S.A. - a notice of termination, within seven days, of Credit Limit Agreement No. CRD/L/25135/07 of September 2nd 2007 executed with PBG S.A. and its subsidiaries: Przedsiębiorstwo Inżynieryjne Metorex Sp. z o.o., Przedsiębiorstwo Drogowo-Mostowe DROMOST Sp. z o.o., Hydrobudowa 9 S.A. (currently Hydrobudowa Polska S.A.), PRID S.A., APRIVIA S.A., BETPOL S.A., and Hydrobudowa Polska S.A., in connection with the fact that in the bank's opinion the Company is under threat of insolvency.

  4. Your personal data shall be stored until you request to cancel the subscription.
  5. The recipients of your personal data shall be the persons authorised by the Controller, i.e. the employees and associates who have to have access to the data to perform their duties, and the Controller's Providers to whom the Controller entrusts the processing of the personal data under and based on the data processing agreements and in line with the requirements of Article 28 of GDPR (i.e.: the provision of IT services).
  6. Giving your personal data is voluntary. However, your refusal to give it prevents us from sending you the newsletter.
  7. You have the right to request from the Controller the access to your personal data. Moreover, you can correct your personal data, delete it or limit its processing, and you have the right to withdraw your consent for data transfer.
  8. You have the right to file a complaint to a supervisory body.
  9. Giving your personal data is voluntary.
